Mr. Sessions ended that practice in January, however, and Tuesday's midterms mark the first time states will vote on legalizing marijuana on the heels of his policy change.

The North Dakota initiative was also unique in requiring "automatic expungement of the record of an individual who has a drug conviction for a controlled substance that has been legalized". If approved, the bill would also expunge criminal offenses that would have been legal under the new law.

US efforts to legalize recreational marijuana use saw mixed results on Tuesday, as voters in MI approved a measure legalizing the drug while North Dakotans looked set to block it. Residents would be allowed to grow up to 12 marijuana plants at their home without a license or purchase pot from a licensed business.

In Missouri, voters will be asked to chose between three separate proposals legalizing medical marijuana to varying degrees. If more than one measure passes, the proposal with the largest affirmative vote will become law.

Transgender rights. Voters in MA said yes to Question 3, which upholds a 2016 state law allowing transgender people to use the public facilities, including restrooms and locker rooms, of the gender they identify with, WBUR reports.

Marijuana is illegal under federal law, though the Obama administration advised prosecutors against pursuing related cases in states that have passed legislation permitting the plant for medical or recreational purposes. A Gallup poll found that 72 percent of Democrats and 51 percent of Republicans support legalization.

Several major companies, including Coca-Cola and Corona beer parent Constellation Brands, are exploring the sale of cannabis-infused products.
